Alan Spergel is the founder and President of SPERGEL, licensed Trustee in Bankruptcy. Alan is responsible for implementing the firm's philosophy to assist debtors in a sensitive and confidential manner, while maintaining the dignity of the individual throughout the process. Today, Alan oversees the firm's entire insolvency team. Alan is also past Chair of the Canadian Association of Insolvency and Restructuring Professionals (CAIRP). As well, Alan serves on the Management Board for the Superintendent of Bankruptcy.
     
Alan has also held the following positions in the past:

  • Member of the Superintendent of Bankruptcy's Management Advisory Board 2009-2011
  • Co-chair of the CAIRP-IIC committee responsible for responding to the Personal Insolvency Task Force's Study and Recommendations for the next set of Amendments to The Bankruptcy and Insolvency Act.

  • Director of the Ontario Association of Insolvency and Restructuring Professionals

Alan is currently a Director of the Camp Wishbone Foundation, an organization which assists challenged youths who are without family support in the Greater Toronto Community.

Stewart Somers,

Since 1976, Stewart Somers has been providing corporate finance and turn-around advisory services to assist public and private corporations in planning and implementing strategies for their business operations in North America and Europe. Stewart has gained the requisite restructuring and operational expertise in such varied business engagements as distribution, farming, food processing, franchising, hotel/property management, light manufacturing, mortgage financing, retail operations (multi location), and real estate development.
     
Mr. Somers joined SPERGEL in 1998 and as Executive Vice President plays a major role in the firm's corporate finance group focusing on mid market corporate restructuring, consulting and turnarounds. Stewart is also the President and co-founder of Knightsford Capital Corporation, a related company of SPERGEL, which facilitates the raising of capital and debt financing for companies facing significant challenges as well as providing various operational consulting services.
     
Recent restructuring engagements in which Mr. Somers had significant involvement include:
  • Court-appointed Interim receiver to market and sell a fully integrated manufacturer of coin-operated touch screen machines for the amusement and gaming industries. The business assets were sold, with the court's approval, for $22 million;
  • Consulting services for an Ontario based chain of 11 pharmacies whose combined secured debt amounted to $50 million. Engagement was to prepare a 2 year forecast of cash flow and to provide various restructuring strategies;
  • Court-appointed receiver and trustee in bankruptcy to realize on the assets of a meat processing business and related property assets which were secured in the combined amount of $3.6 million and whose unsecured debts amounted to 1.1; and,
  • Bankruptcy administration of 3 related Canadian companies providing demolition and environmental remediation contracting services. Total liabilities were approximately $45 million.

Harvey S. Lipman,

Harvey Lipman joined the Spergel team as Senior Vice President during May 2011. Harvey has had extensive experience in the insolvency and restructuring fields since 1982. Harvey has acted for major banks, lenders, and debtors, and assisted clients of accountants and lawyers with their financial needs. Harvey has also acted as Court Appointed Interim Receiver, Trustee in Bankruptcy, and privately appointed Receiver and Manager. Harvey has experience helping lenders and companies in many manufacturing industries including automotive, lumber, food processing, distribution, construction, restaurant and hospitality, marine manufacturing and retail, franchising, transportation, retail, IT and professionals.
     
Harvey is currently on the Board of Directors of the Kidney Foundation of Canada - Central Ontario Chapter and also is Chairman of their annual bowling fundraising event. Harvey is active on other charitable and non-profit organizations for the purpose of fundraising for different worthy causes primarily benefiting children.
     
In the past, Harvey has served on the Board and Executive of The Sigma Alpha Mu Foundation of Canada and for 17 years sat on the Board and Executive of a children's non-profit day camp (Camp Arrowhead).

Deborah Hornbostel,

Deborah Hornbostel is a Senior Vice President at msi Spergel Inc. practising solely in commercial insolvency and restructuring. She obtained her Bachelor of Commerce degree from the University of Toronto and has been a Chartered Accountant since 1989. She has also been a member of the Canadian Association of Insolvency and Restructuring Practitioners since 1990. Prior to joining SPERGEL in 1997, Deborah worked in the corporate recovery department of a national accounting firm in Toronto and also performed related consulting work for it in Europe.
     
Deborah has experience in administrating commercial insolvencies under a variety of legislative vehicles such as Monitor under Creditor's Companies Arrangement Act, Liquidator under the Business Corporations Act, Receiver, Proposal Trustee and Trustee in Bankruptcy under the Bankruptcy and Insolvency Act ('BIA'), and Court Appointed Interim Receiver and Receiver under the BIA and Courts of Justice Act. Deborah has also assisted both creditors and debtors with consulting services for turnarounds, refinancings and asset realizations without formal enforcement proceedings.
     
Deborah's experience covers a wide spectrum of industries. Examples of previous engagements have involved the following industries: construction, retail, manufacturing, real estate, pharmaceutical, agriculture, food processing, restaurant, auto supplies, environmental, logistics, software, sports franchises, entertainment and graphics. In addition, Deborah also has experience in pursuing fraudulent debtors on behalf of lenders and has worked with the RCMP in obtaining convictions against such criminals.

Caryl Newbery,

Caryl's education includes an MBA from Wilfrid Laurier University in 2006 and an undergraduate degree in Finance from the University of Western Ontario. Caryl's experience includes Commercial Lending, Strategy Support and Business Development. Most recently, she worked for the Royal Bank of Canada for over 3 years where she gained expertise in lending to mid-size commercial clients in the Business Services industry, and creating market penetration strategies for the Health Care and Supply Chain markets.
     
Caryl is currently enrolled in the CIQP training program and working towards obtaining the CIRP and the Bankruptcy Trustee License.
     
Caryl enjoys being part of the business community and is the Finance Director for the Canadian Association of Women Executives and Entrepreneurs (CAWEE), a not-for-profit women's networking organization.
