Questions about debt help in Whitby

Your consumer proposal payments depend on your finances and the offer accepted by your creditors. Your trustee reviews your debts, income, expenses, and assets before recommending a repayment amount. Trustee fees are regulated and paid from your proposal payments. Your first consultation with Spergel is free, and we will explain the payments and fees before you decide whether to proceed.

A consumer proposal must be completed within five years, although a shorter term may be possible. Your payment schedule is agreed as part of the proposal, and you can generally pay it off early. Creditors have 45 days after filing to respond or request a meeting under the proposal process. Your trustee will explain how acceptance works and what happens during that period.

The effect depends on your assets, their equity and any secured loans. With a consumer proposal, you generally retain your assets while meeting the proposal terms and maintaining payments to secured creditors, such as your mortgage or car lender. In bankruptcy, some assets are protected by federal and Ontario exemptions. Other assets, or their non-exempt value, may need to be paid into the bankruptcy estate. We will review your ownership, equity and loan payments before explaining what each option could mean for you.

A consolidation loan replaces existing debts with a new loan; a consumer proposal is a legal agreement with your unsecured creditors. A loan still requires you to repay the borrowed balance and interest under the new terms. A consumer proposal can reduce eligible unsecured debt and stops interest on the included debts. It also affects your credit record. Compare debt consolidation and consumer proposals, then speak with us about the payments and responsibilities of each option.

Filing a consumer proposal or bankruptcy can stop collection calls and wage garnishments for eligible unsecured debts. Booking a consultation alone does not create that legal protection. The effect depends on the debt and the type of garnishment. Tell us if money is already being taken from your pay so we can review the circumstances and explain the available steps.

Unsecured CRA tax debt can generally be included in a consumer proposal. The CRA participates as a creditor, and the proposal must follow the legal acceptance process. A registered CRA lien or other enforcement action can change how the debt is treated. Bring your tax statements and any notices so we can explain which debts can be addressed and what may need separate attention.

You can start by phone without visiting the office. Call 416-497-1660 or use our online booking form to arrange a free consultation and discuss the appointment options.
